The clerk magistrate hearing is the first of two potential appeal hearings pertaining to your citation. If you are successful at the Clerk Magistrate’s Hearing, there is no further action required.  On the other hand, if you are unsuccessful at the Clerk Magistrate Hearing, you have the right to appeal the ticket to a judge.  In addition, the police also have the right to appeal the decision of the Magistrate to a judge.

Judge Appeal Hearings at Westborough District Court

Either Party may request a Judge Appeal following the decision of the Clerk Magistrate.  As a result, the ticket will be heard on a later date in front of the judge in open court. At the Judge Appeal Hearing on the ticket, the judge will listen to the testimony and arguments of both parties, including the officer or Massachusetts State Trooper who issued the ticket.  At the conclusion of the hearing, the judge will make a decision as to responsibility.
