Recent Changes to the Criminal Larceny Law in Massachusetts

On April 13, 2018, Governor Charlie Baker signed An Act Relative to Criminal Justice Reform.  Among other things, this Act makes changes to the current Massachusetts Criminal Law as it pertains to the Criminal Charge of Larceny.

Prior to the recent law changes, the threshold between a misdemeanor and felony larceny was $250.00.  In other words, if a person was previously charged with larceny and the value of the property taken was $250.00 or above, that person would have been charged with a felony.

Under the new version Massachusetts law, the threshold for a felony larceny charge has increased from $250.00 to $1,200.00.  Thus, if a person is accused of taking property valued below $1,200.00, he or she will be charged with misdemeanor larceny. This change in the law is beneficial to those facing charges of larceny as the penalties for the crime vary depending on whether it is a misdemeanor or felony charge.
