Negligent Operation Citations in Massachusetts

In Massachusetts, the police may issue citations for Negligent Operation of a Motor Vehicle.  Negligent Operation is considered a criminal offense in Massachusetts.

Unlike many other crimes, the police in Massachusetts may notify a driver that he or she is being charged with Negligent Operation by giving the driver a criminal traffic ticket at the scene.  It is also possible to receive a ticket in the mail if the police needed additional time to investigate the situation.

Since a Negligent Operation Ticket involves a criminal charge, it is very important to speak with a Massachusetts Negligent Operation Ticket Defense Attorney about your case as soon as possible in order to best protect your rights.

If you have received a Massachusetts Uniform Citation listing Negligent Operation as an offense, the ticket must be signed and filed with the applicable District Court within 4 days in order to request a Clerk Magistrate Hearing on the Application of a Criminal Complaint.

At Caselden Law, our firm has successfully defended hundreds of Criminal Traffic Tickets in courthouses across Massachusetts.

How Can I Be Sure That I am Being Charged with a Crime?

There are generally 2 ways in which a person is notified that there are criminal charges being filed by the police:

  1. The Massachusetts Uniform Citation – If the offense on the ticket is criminal, the police officer will check the “crim” box next to the offense.  In addition, the officer will check the box marked “Criminal Application (See Instruction B on Back).”
  2. Summons to Appear – Depending on the offense and the immediate action taken by the accused, a driver may receive a Summons in the Mail for a Clerk Magistrate Hearing or an Arraignment.  The Summons will list the time, date, and location of the Hearing or Arraignment on the Negligent Operation Charge.
