In Massachusetts, the police may issue a citation to a person for employing or allowing an unlicensed operator to drive a motor vehicle. These charges are considered misdemeanor criminal offenses under Massachusetts Law.

These offenses are generally charged in one of the following three ways depending on the circumstances:

  1. Employing Unlicensed Motor Vehicle Operator
  2. Permitting Person with Suspended or Revoked License to Operate Motor Vehicle
  3. Permitting Person with Ignition Interlock to Operate Without Devise.

It is important to take immediate action when dealing with criminal citations in Massachusetts. In order to obtain a clerk magistrate’s hearing prior to arraignment, a request for a hearing on the application for a criminal complaint must be filed in the applicable District Court within 4 days.

In addition to the citation for permitting unlicensed operation, the driver of the automobile will also receive a criminal citation for unlicensed operation.
