Clerk Magistrate Hearings at Salem District Court

In addition to courtroom business, the Salem District Court also conducts “Clerk Magistrate Hearings” when dealing with certain violations and crimes.  Clerk Magistrate Hearings take 2 forms:

  1. Civil Clerk Magistrate Hearings – Civil Clerk Hearings are held when a person is appealing a civil motor vehicle infraction, such as speeding, marked lanes violations, and other civil moving violations.  At the conclusion of the Clerk Magistrate Hearing for a Civil Traffic Ticket, both the driver and the police officer have the right to appeal the decision of the Clerk to a Judge.  If this occurs, the case will be set up for a subsequent hearing known as a “Judge Appeal.”
  2. Criminal Clerk Magistrate Hearings – Criminal Clerk Magistrate Hearings, also referred to as “show cause hearings” or “Clerk Magistrate Hearings on an Application for a Criminal Complaint,” are regularly held at the Salem District Courthouse.  At a Criminal Clerk Magistrate Hearing, the Magistrate will determine whether there is probable cause to issue the Complaint.  Once the Criminal Complaint issues, the case is set up for an arraignment.
