Clerk Magistrate Hearings in Framingham District Court

Depending on the nature of the offense, certain cases may go before the Clerk Magistrate at the Framingham District Court. Generally speaking, cases heard by the Clerk Magistrate involve civil and criminal infractions.

Civil Motor Vehicle Infractions (CMVI)

When appealing a traffic ticket, the case will first be scheduled for a clerk magistrate hearing. Following the decision of the clerk magistrate, both the appealing party and the police have the right to appeal the decision of the clerk to a judge. If an appeal on the civil moving violation is requested by either party, the case will be set for a Judge Appeal. At the appeal, a judge will make a determination as to responsibility. Some of the more common civil moving violations handled in the Framingham Court include:

Clerk Magistrate Hearing on an Application for a Criminal Complaint

Certain criminal charges may be heard by the Clerk Magistrate. Some of the more common charges include:

Framingham District Court Arraignments

Other criminal charges, such as assault and battery, are generally scheduled for an arraignment rather than a clerk magistrate hearing. An Arraignment may occur shorty after an arrest is made or the defendant may receive a summons to appear for an arraignment in the mail from the Framingham District Court.

At an arraignment, the defendant is formally charged with the criminal defense. If the Commonwealth is requesting bail, that issue will be addressed at that time. Following the arraignment, the case will likely be set up for a pre-trial conference. If you have received a summons to appear in the Framingham District Courthouse or any other Massachusetts Trial Court, it is important to speak with a Criminal Defense Attorney as soon as possible in order to protect your rights.
