Concord District Court conducts clerk magistrate hearings for 2 types of cases:

Criminal Clerk Magistrate Hearings

Criminal Traffic Tickets and other Misdemeanor crimes are often heard by a clerk magistrate prior to the case going to arraignment. Some of the more common criminal offenses heard by the Clerk include:

Often times, our clients learn that they are facing charges in one of the following ways:

  1. Criminal Citation – The police may issue a criminal citation in hand to a driver.  This citation will not have a dollar amount listed.  Rather, the ticket will list the offense and will have the “crim” box checked off next to the offense.  In addition, the Massachusetts Uniform Citation will also have a box checked above the officer’s signature, indicating that the ticket is a “Criminal Application.”  If you have been given a ticket with a criminal offense listed, it is important to speak with an attorney immediately as their are strict time requirements for certain procedural benefits.
  2. Notice by Mail – The Concord District Court will also mail a “Notice of Magistrate’s Hearing on Complaint Application.”  This letter will inform the accused of the time and date of the hearing.  The notice will also list the offense counts that will be discussed.

At the Clerk Magistrate’s Hearing, the Clerk will hear testimony from the police and the accused.  The Clerk will then decide whether or not to issue the application for criminal complaint.  If the complaint is issued, the case will then proceed to Arraignment.

Arraignments

While some cases first go before a Clerk Magistrate, other cases will begin with an Arraignment.  Some of the more common charges brought at arraignment include:

At an arraignment, the Assistant District Attorney will state the charges for the record.  If there is a question of bail, the judge will hear arguments from both the prosecution and the defense. Following an arraignment, the case will then proceed to the pre-trial discovery and motion stage before the case is set for a jury trial.
