Criminal Charges in Massachusetts
When dealing with criminal charges in Massachusetts, the process and defense depends largely on the circumstances of each case. Generally speaking, one receives notice of potential criminal charges in one of the following ways:
- Summons in the Mail for an Arraignment
- Summons in the Mail for a Clerk Magistrate’s Hearing on an Application for a Criminal Complaint
- Criminal Traffic Ticket / Citation
- Arrest
- Straight Warrant or Arrest Warrant
If an arrest has been made, the person is brought before the judge on the next business date for an Arraignment.
Arraignments in Massachusetts Criminal Court
An Arraignment takes place if a person has been arrested by the police or has received a summons in the mail after the incident took place. An arraignment will also be scheduled if you have received a traffic ticket with a criminal offense listed and did not request a clerk magistrate’s hearing within the 4 day time limitation.
At an arraignment, the defendant is formally charged with the offense and a plea of not guilty is entered by the court. In addition, the District Attorney will address the issue of bail and any other conditions that must be followed while the case is pending.
At the conclusion of the arraignment, the court will usually set the case up for a pre-trial conference.
Some of the more common offenses resulting in arrests include:
- Drunk Driving (OUI / DUI)
- OUI Drugs
- OUI Marijuana
- Assault & Battery
- Assault & Battery with Dangerous Weapon
- Drug Crimes
- Criminal Traffic Citations
At Caselden Law, our Boston Criminal Attorneys have a superior understanding of the criminal justice system. We will fight for your rights every step of the way from arraignment through trial.

Clerk Magistrate Hearings on an Application for a Criminal Complaint
For certain misdemeanor crimes, the case may be set up for a Clerk Magistrate Hearing on an Application for a Criminal Complaint. Some of the more common crimes that are heard at the Clerk Magistrate level include:
- Driving on a Suspended License
- Driving to Endanger
- Unlicensed Operation of a Motor Vehicle
- Negligent Operation
- Attaching Plates
- No Insurance / Uninsured Motor Vehicle
- Revoked Registration
- Leaving the Scene of an Accident
While Clerk Magistrate Hearings are often very beneficial, it is important to have an experienced Boston Criminal Lawyer present at your hearing in order to protect your rights.

SUPERIOR LEGAL SERVICES
Being investigated, arrested or charged with a crime or other unlawful violation is often a stressful and difficult experience. In addition to facing potentially serious penalties if convicted of an offense, the consequences of having a criminal record often extend well past the courtroom.
Often times, those charged with committing an illegal offense in Massachusetts also face negative consequences at their place of employment, school or other aspect of their lives. With these potentially severe and long lasting consequences of being charged with a crime in mind, it is important to contact a Boston Criminal Defense Attorney as soon as possible to discuss your options. At Caselden Law, we fight for your rights and provide you with aggressive legal representation during every stage of the process.
From the moment that we begin representing you until the case is resolved, we will zealously advocate on your behalf. We will closely examine each and every piece of evidence that the district attorney has in his or her possession and will file motions challenging any aspect of the evidence which may be inadmissible at trial.
In addition, we will closely cross-examine any and all potential witnesses, including police officers & expert witnesses, in order to give you the highest likelihood for success. We will also explore the possibility of resolving the case through plea negotiations with the district attorney should that be applicable to your situation. Furthermore, your criminal defense attorney will fully explain your legal rights and will explore every legal argument available in your case.
Our firm handles a wide range of criminal matters, including:
- OUI
- Leaving the Scene of an Accident
- Assault & Battery
- Negligent Operation of a Motor Vehicle
- Operating to Endanger
- Operating After Suspension
- Unlicensed Operation of a Motor Vehicle
- Criminal Citations / Tickets
- Drug Crimes

As your voice, we will closely review police reports, 911 calls, arrest reports, booking videos, breathalyzer tests, photographs, physical objects, witness testimony and any other available evidence.
